Parenting After Divorce – Cooperative, Parallel, or Somewhere In-Between?

This excellent article was created by our Parenting Coordination expert, Cindy Harari, Esq.

One of many difficult things parents must do after divorce is deal with their child’s other parent. While some aspects of “the deal” are spelled out in documents such as temporary or permanent court orders or final marital settlement agreements, most of the “parenting” details are not explicitly written down.

For example, a document provides that the child spends every… Continue

How To Get A Divorce If You Want Your Kids To Lose

I read an article about a divorce custody fight in one of the major local papers down here in South Florida. Even for a reformed "killer" divorce lawyer turned divorce mediator such as myself, it made me sick to see what can happen when the divorce process spins out of control. This case truly epitomizes how to get a divorce if you want your kids to be the ones who really lose.

In this divorce case, each of the parties hired the highest-powered, gun-slinging divorce lawyers… Continue

Divorce Settlement: Inspire The Desire

I recently had a divorce mediation where, as often is the case, I was working with two divorce lawyers and two co-parents who couldn't stand each other. It literally took me hours to get them into the same room together and, although these parties had many written divorce settlement agreements between them, years later we were still there, fighting over interpretation and compliance.

In speaking with them alone (I sent the lawyers out of the room to do child support and other… Continue

Holding The Vision

What would you like your relationship with your spouse or ex-spouse to look like? Have you ever thought about it? How can you get what you want, if you don't know what you want?

Most people spend their time thinking about what they don't want, rather than what they do want. You know that what you focus on expands.

How about sitting down and figuring out what your perfect relationship with them would look like? Whether you are going to stay married or get…

Peer Pressure

Why do such a large percentage of people find it difficult to accept the lack of animosity we feel toward each other? So many feel that we should not talk, not smile at each other, not share a meal.

For example, I (briefly) dated a woman here in Santa Barbara, whom I will call Mary. Mary has two grown children and has been separated from her husband for over a decade. Mary and I had dated twice when she saw my (soontobeEx) wife, myself and a friend at a local jazz club.

I,… Continue

Honor Your Ex

Why not continue to honor her even though we are no longer compatible as marriage partners?

Why give her less honor than I would give any woman in any situation just because I happened to have been married to her?

In fact, to honor her less would be an insult to my own ability to select a marriage mate in the beginning. Perhaps she was the perfect choice for me at the time but is no longer.

I choose to honor her as a I would any person, and to honor her so as to… Continue

Let It Slide

I find that objectively looking at what is best for the children causes me to set aside my pride and sense of entitlement and accept a situation that otherwise might cause me to retaliate in anger.

Remembering that the unkind things that my partner occasionally says are a byproduct of the stress she is feeling and not indicative of who I really am as a person, helps me take things in stride. Her opinion is skewed by her current emotional state, not necessarily by any legitimate… Continue

Don't Bad Mouth Your Ex or SoonToBe Ex

We all have experienced the pain of hearing that someone, perhaps even a close friend, has said something negative about our character, appearance, family, etc.

It also seems that often those comments have been taken out of context, exaggerated, or even completely fabricated. Nevertheless, it hurts to hear that others think poorly of us. And if indeed someone did deliberately defame us, that is especially painful.

Why say anything about our ex-partner that could be… Continue

Board Certified Divorce Lawyers and Peaceful Divorce?

When you decide to start looking for a divorce attorney, do you think about going to a divorce lawyer who is "Board Certified"? One who has been certified by his/her peers as an "expert" who specializes in matrimonial law? Well, you may want to re-think that idea if you want a peaceful divorce.

Although it varies from state to state, the requirements for a divorce lawyer to become a board certified divorce attorney are often based upon how much time that lawyer spends in trial. Think… Continue

What to advise clients who are thinking of divorce

Every now and then you will get a call from a client asking for a referral to a divorce attorney. Like all referral situations, a recommendation can have serious repercussions if the work isn't done properly or the parties don't like each other. You can win or lose big depending on the outcome. You want to steer your client in the right direction but just don't know who to trust with your most precious resources, your reputation and your clients.

The words that you are about to read… Continue

Mediate, Don’t Litigate!

For the life of me, I can’t figure out why anyone would litigate their divorce when they have the option to mediate. Is it even possible in this day and age that anyone considering getting a divorce, in the middle of a divorce, or already divorced and still fighting with their ex hasn’t heard about divorce mediation?

Ask anyone who has been to divorce court how they liked that experience. We know who the only winners are there – the divorce lawyers! But don’t blame them, if you hire… Continue

How Important Is the Budget in Divorce Planning?

I think everyone’s least favorite word is BUDGET. Why don’t we want to hear that word? Think about it: We’re asking ourselves to do something we don’t want to do — or worse yet, someone else is asking us to do it. While we might not like them, having a budget does help. In divorce planning — whether you are going to litigation,…See More

21st Century Parenting Plans

I remember when the default custody arrangement had one parent as the custodial parent, and the other parent was known as the “Disneyland parent.” They had their children every other weekend, and maybe once during the week for dinner. Today it is more common to see joint parenting time consist of one week on, and one week off or “two-two-five-five” time,…See More

Including a Financial Professional in Your Mediation

Very often, couples who are divorcing amicably, or who have straightforward financial situations, will forgo meeting with a financial professional while they go through mediation. Though this may seem logical on its face, “going it alone” may result in unnecessary hardship and inaccurate calculations.  It is easy to simply look at a tax table today and say “I am going…See More

What About the House?

Going through divorce means dealing with hundreds of details, some more important than others. One detail that merits extra contemplation is how to deal with the marital home.Does one spouse want to keep it because the children still live there? You don't want to disrupt their lives any more than is already happening. What if the children are grown? Do you still need that much of a house? Here are the three most common means of dealing with the house in divorce:Selling the house and dividing the…See More
